If the government is serious in pursuing a more democratic and open Malaysia, then the Universities and University Colleges Act (UUCA) and the Official Secrets Act (OSA) should be abolished too.What people says?

Tan Kim Keong He’s right on the OSA. However his intention regarding strengthening preventive elements with regards to the new law is only from one perspective i.e. not to question anything to do with Ketuanan Melayu or institutionalised racial discrimination. He sees standing up for one’s equal right under the Malaysian sun as a threat or encroachment to him, his race and his kind. Racism is written all over in his intention.

David Dass Ibrahim Ali ! Inconsistency is thy name. Yesterday he opposed liberalization. Today he supports it. He wants the Official Secrets Act and the University and Colleges Acts repealed. Critics of the OSA have always said that the OSA must not provide cover for questionable governmental activity. The Rakyat have called for more open and transparent government. We now have a Freedom of Information Act in Selangor. As for the University and Colleges Act there have been many calls for its repeal or at least for its more offensive provisions to be amended. University autonomy is universally regarded as an essential attribute for a center of higher learning. Lecturers and students have to experience their own empowerment to unleash their intelligence and creativity. No such noble purpose for Ibrahim Ali. There are close to a million undergraduates. He remembers his student days. And thinks that he can rabble rouse these undergraduates. Good luck to him. Students are smarter and more aware today.

JusticeKini YES- for the first time I can agree with Ibrahim Ali but with a caveat- Ibrahim Ali MUST GO TOO. His warped thinking that the two new acts must include protection of Islam and special rights which are all in the constitution. Does Allah needs a nincompoop like Ali to protect Islam? Onyourtoes Kuduka, I do not work for a telco. I am just looking at tax equity and efficiency. Has it ever occurred to you that managing all the prepaid customers probably required higher operating and incidental costs than managing post paid customers and therefore requiring other compensating revenue to keep the business viable? In any case, we are barking at the wrong tree. There are many things more urgent and important for us to look at than prepaid service tax. It is a red herring; the government just wants to show that it is sensitive to the lower income groups, more so the financial burden is not on the government. By the way, if you are a service provider, is it fair to you if the government has asked you to pay the service tax on behalf of your customers when it is the government who is pocketing the tax?

If the government can routinely ask the telcos to do it, can it not ask you too because your customers can also be complaining that the cost of living in the country is raising and they can’t make both ends meet. Cost of living issues are very complex probably requiring much more comprehensive solutions. It also requires how individuals, particularly those earning less, to learn how to manage their money better. It is my humble observation that many lower income earners spend too lavishly and unnecessarily. I have a better idea on how we could help the lower income groups to spend less and save more and hurt the telcos – just ask them to talk less over the phones; in most cases it is sheer waste of time and unproductive anyway.

Besides are family members are they actively engaged in such duties to be postal voters. In that way they are free to vote without some being appointed by their chiefs to mark the ballots for them. Perak Mufti Harussani Zakaria had once advised Prime Minister Najib Abdul Razak that it is the government’s “weaknesses” and “corrupt” practices that have divided the Malay community, he revealed today.

Malaysian Born Well this chap likes the sound of his voice and is one of the most crass political opportunists in the country. He enjoys coming out with controversial statements using non-muslims as his favorite boogeymen. For him to openly turn on the prime minister is an indication that he has now collected his fee of 30 pieces of silver and is now doing his masters bidding. Looks like an internal struggle in UMNO. For him to say that he advised prime ministers is a joke, he is a class clown who knows how to manipulate racial and religious sensitivities, he represents the lowest form of political tool and these days spends his time stirring discontent and fear among the lower income group and rural muslims. What a shame that a low life like this is given such prominence and face when vermin like him should be shown the door.

David Dass The problem was and is not Islam. The problem is one Mufti Harrussani Zakariah. This is not the first time that he has tried to stir up trouble between Muslims and non Muslims. He was the one who sent out a text message – saying that thousands of Muslims had been converted into Christianity and that a Catholic Church in Ipoh was baptizing Muslims. Malay language daily Sinar Harian today apologised for publishing an information text box accusing the ‘Christian movement’ of, among others, permitting prostitution and encouraging free mingling between the sexes.

1M – If an insult of half the magnitude is to be done on them, I bet they will come out in groups all over the country shouting “Don’t test our patience” or “Don’t take our silence as timidity” or “Balik Cxxx” and so forth. Imagine you call them prosxxxxxx … I dare not think what will be the outcome. But when they do the same to others, they just have to apologoize the following day on page 8. Those Christian ministers in Najib’s cabinet should say something, they should not keep silent while watching their fellow brothers and sisters being intimidated and insulted like this.

Opposition Leader Anwar Ibrahim’s defence enters its third day today with the prosecution cross-examining forensic pathologist Dr David Wells.

The Australian expert, who is the third defence witness, has yesterday told the court that the alleged semen sample retrieved from sodomy complainant Mohd Saiful Bukhari Azlan could not have revealed the desired results.

This was because the sample was taken more than two days after the alleged incident.

The alleged sodomy incident happened in the afternoon of June 26, 2008, and the sample was retrieved from Saiful between 9pm and midnight on June 28, 2008.

In addition, he said that the sample was not properly stored in the police station and it was given to chemist for testing two days later.

Dr Wells, who is an expert in the field of sexual assault cases, also testified yesterday that when retrieving samples from alleged victims, he would be working alone and only assisted by nurses. This, he said, was to prevent contamination.

In the case of Saiful, four doctors attended to complainant in retrieving samples in the present of investigating officer Supt Jude Blacious Pereira.

It expected that the prosecution will question Wells on Saiful’s Hospital Kuala Lumpur medical report, which the doctor had described as inaccurate.

After Wells, another Australian expert hired by Anwar, DNA specialist Dr Brian McDonald, is expected to take the witness stand.

CHKS -As a medical doctor, I fully agree with Wells, how can you extrapolate a principle just based on an anecdotal case report? Furthermore the case was reported 30 years ago! Yusof, if u have a disease, would you want a treatment proposed 30 years ago, just because treatment was proved effective just in 1 out of millions patients?

Kit P- Even a layman, let alone an expert of Dr Wells’ stature, can understand the anus is a very dirty and hostile environment to retrieve an unambiguous sample of semen after 48 hours. Either Anwar has super semen or Saiful has a super-clean anus (yeah, after holding his faeces back for more than 48 hours). To me this whole trial goes into “something is not right” status. For a judge to fail to pick this up suggests there are many other external pressures which are being applied.

Disbeliever- Obviously the solicitor-general II, Mohd Yusof Zainal Abiden is trying to play the fishing game and doing his best to catch Wells on a wrong footing. But from the cross-examination we can safely say that Wells is indeed a professional and knows what he is saying. The SG II is at his wits end trying to find a flaw in Wells which I’m certain he will fail miserably.

Lakia- Again after slightly over an hour the learned prosecutor asked for another break this time allegedly to check whether he has covered all the areas even though he has with him a number of DPPs. What have he and these DPPs done before this then? Sleeping? or just couldn’t understand what Dr Wells has been explaining or just do not know what question to ask after every questions have been answered very well and not according to their expectation.

AnakMalaysia -The reason why this case can NOT go into Islamic syariah court is that it will be thrown out immediately. With no proof or 4 trusted, credible witnesses watching the act, there would be no case against Anwar, but a major case against Saiful. With the present civil court, they can go on and on with all sort of spinnings, lies even under oath. Poor UmNgok!

COMMENT Malaysia is 47 years old through the unification of Malaya, Sabah, Sarawak and Singapore in 1963. (Singapore was separated from Malaysia in 1965.)

The Kuala Lumpur-Kota Kinabalu-Kuching relationship must be relooked because of the imbalance between the centre and the periphery.

Most importantly, the 20-Point Agreement has been largely ignored in making the Malaysia that we have today.

Initial attempts by Sabah first chief minister Fuad Stephens to do so resulted in him being made Australian High Commissioner.

As a result, there were regressions from Sabah’s 20-Point Agreement and Sarawak’s 18-Point Agreement as seen in the “Allah” controversy and the ban on the Malay language Bible.

Both agreements on religion state that there should be no state religion for Sabah and Sarawak.

The “Borneonisation” of the public service as agreed to in the deal has also been violated. Over the years, more public servants from the peninsula were transferred to Sabah to fill in the void.

What development?

Unfortunately, an ignorant Deputy Transport Minister Abdul Rahim Bakri recently stated that Sabahans in the interiors should be grateful as Sabah’s inclusion in Malaysia had ensured development in the state.

Using development as a bait is wrong because “development is the one term most used by politicians to cheat the people” (quoted from a Malayalam movie).

If development had indeed been provided, why is the road network in both states still bad? My brethren from both Sabah and Sarawak can attest to the fact that Sabah and Sarawak are two decades backwards compared to Peninsular Malaysia.

What development is Rahim speaking about when my brethren over there are still having difficulties to complete 11 years of education?

Contrary to Rahim’s statement, Kuala Lumpur has gained more than Kuching and Kota Kinabalu in the 47-year-old relationship.

The most recent evidence was Barisan Nasional’s slim majority in the 2008 general election, which was only made possible because of the safe deposit votes from Sabah and Sarawak.

In addition, the Mahathir administration should be “thanked” for initiating the IC project that created BN voters out of illegal immigrants from Indonesia and the Philippines

To address the imbalance, more autonomy should be accorded to Sabah and Sarawak. It can be initiated by increasing the petroleum royalty from the current 5% to 20%.

Secession by both Sabah and Sarawak is out of the question as it violates the agreement

“How can we investigate any misconduct if no report is made? If it is true, then why should the public be scared to make a report?” : Selangor CPO Khalid Abu Bakar, addressing allegations of misconduct by police personnel in Selangor, as reported in Malaysiakini.

Khalid was further reported as saying that “The public should not fear to inform the authorities about police misconduct… if they are still scared, then they should communicate directly with me”, and went on to suggest that such information could be channeled to him through his Facebook account.

Khalid, it seems to me, is confused.

Is a police report needed before a matter can be investigated?

Now, RPK reminded us in a post a few days ago that the complaint, on 28th August, last year, by ASP Noor Azizul Rahim Bin Taharim, the ADC (aide-de-camp) of finally – retired IGP Musa Hassan, contained in a statutory declaration and alleging many criminal acts by Musa appears to have been NFA’d ( no further action ) by the police.

Based on RPK’s posting, it appears that Noor Azizul had sent a copy of his statutory declaration to Dr M who, in turn, passed the same on to former IGP Tun Haniff Omar.

In essence, Noor Azizul has made two very serious allegations in his statutory declaration against Musa.

One, that Musa had inappropriate connections with underworld figures, and that these connections extended to a particular underworld figure making decisions on the promotion, posting and ranking of officers in PDRM.

Two, that Musa had directed a covert operation involving the creation of a blog through which false allegations of corruption were made against then deputy minister of Home Security, Johari Baharom.

RPK says that none of these allegations against Musa were ever investigated.

If RPK is wrong and an investigation had been conducted, someone would have had to be charged.

Either Musa, for being implicated in the matters alleged, if found to be true, or Noor Azizul, for swearing out a false statutory declaration, if an investigation had cleared Musa of the charges.

Neither were charged, thereby suggesting that RPK is right in that this matter was never investigated.

Why?

RPK’s post does not mention any police report being lodged with regard to the matters raised in Noor Azizul’z statutory declaration.

Might that be the official PDRM reason, if an explanation was now sought for not investigating this matter, given CPO Khalid’s poser : How can we investigate any misconduct if no report is made?

Does this now mean that either Musa or Noor Azizul have gotten off scot-free, because someone in PDRM directed that no further action be taken?

Yesterday, brand new IGP Tan Sri Ismail Omar was reported in the Star as saying :“I want all police officers and those in the rank and file to discharge their duties according to the law to upkeep the image of policing” .

All talk?

Test him?

How to investigate if no police report is made, did CPO Khalid say?

Shall we oblige with reports from Kedah in the north through to JB in the south, and in Kuching and Kota Kinabalu,just so our new IGP understands just how seriously we treat this matter and that the image of PDRM under his watch is at stake?
